Terms of Service

Service Operations & Use Agreements

By accessing, browsing, or utilizing the GovTech technology assistance platform of the US Visa Processing Center (USAVPC), the user hereby covenants, agrees, and binds themselves to the following terms, conditions, and provisions. Please review this document with qualified legal counsel prior to execution.

1. Disclaimer of Official Agency Status and Absolute Exculpation from Legal representation

USAVPC operates strictly as a private, independent document assistance technology platform. Under no circumstances shall USAVPC be construed as a law firm, consular office, or government affiliate. No attorney-client relationship is established. The user acknowledges that USAVPC does not render legal counsel, visa strategies, or representation, and is entirely separate from the United States Department of State, U.S. Embassies, and any foreign or domestic state organs.

2. Irrevocable Covenant of Accuracy, Veracity, and Data Indemnification

The user warrants and represents that all data, materials, personal declarations, and documentation uploaded or entered into the platform are true, complete, and legally valid. The user hereby agrees to indemnify and hold harmless USAVPC and its affiliates from any liability, penalty, visa denial, or immigration bar (including under INA 212(a)(6)(C)(i)) resulting from erroneous, incomplete, or false declarations submitted by the user.

3. Absolute Absence of Outcome Warranty and Acknowledgment of Consular Discretion

The user explicitly concedes that visa adjudication decisions rest solely within the discretionary sovereign authority of the interviewing Consular Officer. USAVPC, its employees, and agents make no representations, warranties, or covenants regarding the success, speed, or approval of any application. Any estimation, VisaScore™, or assessment provided constitutes non-binding statistical analysis.

4. Independent Fees, Liquidated Damages, and Irrevocable Non-Refundability

All fees transacted with USAVPC are separate from mandatory government fees (e.g., MRV, SEVIS). All payments made to USAVPC constitute liquidated damages for platform reservation and processing allocation and are strictly non-refundable and final immediately upon transaction execution, regardless of application outcomes, processing delays, or user cancellation.

5. Absolute Waiver of All Legal Actions, Release of Claims, and Complete Exculpation

By executing this agreement, the user hereby unconditionally and irrevocably releases, waives, and covenants never to initiate, participate in, or prosecute any legal action, lawsuit, class action, administrative complaint, or arbitration of any nature against USAVPC, its directors, officers, employees, agents, parent entities, subsidiaries, affiliates, or associated companies, since this service does not guarantee visa outcomes or appointments. In the event this waiver is deemed partially invalid, the user agrees that the absolute maximum aggregate liability of USAVPC and all released parties shall be strictly capped at the actual sum paid by the user to USAVPC.

6. Consent to Data Transmission, Processing, and Perpetual License Grant

The user hereby grants to USAVPC, its affiliates, and processors a worldwide, perpetual, royalty-free, irrevocable, fully sublicensable license to process, analyze, transmute, and transmit all submitted data, passport scans, and metadata to execute services. The user consents to the secure storage of their information according to our Privacy Policy.

7. Proprietary Intellectual Property, Anti-Scraping Covenants, and Non-Compete Restrictions

All software code, visual UI architectures, audio stress engines, heuristics, algorithms, and VisaScore™ systems are the sole and exclusive proprietary property of USAVPC. The user is strictly prohibited from scraping, harvesting, decompiling, reverse engineering, or utilizing any component of the platform to build or train competing platforms, products, or services. Breach of this section triggers immediate injunctive relief and liquidated damages of no less than $100,000 per violation.

8. Unilateral Suspension, Decoupling, and Termination Rights

USAVPC reserves the absolute, unilateral, and discretionary right to suspend, terminate, or restrict service access, account registration, or visa assistance to any individual, without prior notification or liability, for reasons including but not limited to: suspicion of fraudulent declarations, abusive behavior, attempts to bypass chatbot filters, or non-compliance with these terms. In such events, all fees paid are permanently forfeited.

9. Governing Law, Exclusive Forum Selection, and Severability of Provisions

This agreement, and all claims or disputes arising hereunder, shall be governed by, and construed in accordance with, the laws of the State of Delaware, without giving effect to any principles of conflicts of law. Any legal proceeding or arbitration shall take place exclusively in Wilmington, Delaware. The user waives any right to a trial by jury. If any provision of these terms is deemed unlawful, void, or unenforceable, that provision shall be severed without affecting the validity and enforceability of the remaining provisions.

10. Non-Privilege of Communications and Third-Party Dependencies Disclaimer

The user acknowledges that because no attorney-client relationship is established, communications with USAVPC, its chatbots, agents, or assistants are not protected by the attorney-client privilege or work-product doctrine. Furthermore, USAVPC disclaims all liability for outages, data corruption, or delays caused by third-party systems, including Stripe, Supabase, MiniMax, OpenAI, or the State Department's Consular Electronic Application Center (CEAC).
